VTA Clarifies Civil Grand Jury Report Findings While Continuing to Advance BART Silicon Valley Phase II

The Santa Clara Valley Transportation Authority (VTA) appreciates the Santa Clara County Civil Grand Jury's review of the BART Silicon Valley Phase II (BSVII) Project and welcomes the opportunity to address its findings and recommendations.

Clarifying the Record

In reviewing the report, VTA identified several factual inaccuracies. Among the most significant are references to project funding sources. To be clear, any reference to $375 million of Regional Measure 3 (RM3) funds is related to the RM3 bridge toll enacted by Bay Area voters in 2018, and none of the project funding is contingent on any pending sales tax measure.  Additionally, VTA has made several public declarations affirming no funding from a potential November 2026 ballot measure will be allocated to BSVII. These and other factual inaccuracies will be addressed in VTA’s formal response, which requires approval by the Board of Directors. VTA’s response is due within 90 days.

Construction Moves Forward

BSVII is one of the most significant transportation investments in Santa Clara County's history. The project will extend BART service into downtown San Jose and Santa Clara, improving regional mobility, expanding access to jobs and opportunities, and supporting Silicon Valley's long-term economic growth.

The project is actively under construction and continues to make measurable progress. VTA recently completed support of excavation work for the tunnel launch structure, a major milestone that prepares the site for the arrival of the tunnel boring machine and the next phase of construction. Work remains on schedule and within budget.

Over the past several years, VTA has strengthened project oversight and accountability through the creation of the BSVII Oversight Committee, enhanced coordination with BART, monthly updates to the VTA Board of Directors, and regular briefings for state and federal elected officials. Many of the issues discussed in the report have been raised previously and either resolved or are being actively addressed.
